Keeping ownership
The Patent system is focused on Publishing the new patents, so this original security of protection in not sufficient for gifted inventors and initial investors, mostly since the PTAB had been added to the AIA. (See note at the end) The very original intended protection for inventors is now the most risky way to enter new technologies and patent any products and/or services without being able to protect the commercial rights as it was through history for many centuries.
In the past, “Commercial Protection” Insurance was the additional option, but for our times registering a patent without commercial protection is the worst way for inventors and investors to venture into. In fact, infringement is almost legal and without strong market position the risks are more then ever before.
Kipping ownership in our time is not publishing new Intellectual Properties until the strong partner is found, but not as a Take-Over or Infringement but as the Commercial Protection Partner. This win win is also good for the company which will take over the technology at better terms in the early stage as well as the owners of the project.
(The Leahy–Smith America Invents Act (AIA) is a USA federal statute that was passed by Congress and signed into law by then President Barack Obama on September 2011 is a law which represents the most significant legislative change to the USA PTO system since the Patent Act of 1952)
